Designated factory filing program in accordance with the Factory Location Act
Factories to which the following requirements apply are required to submit a designated factory filing in accordance with the Factory Location Act.
Note: Administrative authorities regarding filings under the Factory Location Act have been transferred to municipalities as of April 1, 2017. For details, contact the municipality where you seek to site the factory.
1) Filing for newly building (or modifying) designated factories
Instances where filing is required
When constructing new buildings or making modifications at a factory with a plot size of 9,000m2or larger or building area of 3,000m2or larger.
Instances where filing concerning modification is required
- When production facilities are to be expanded
- When increasing or decreasing the plot size
- When reducing the area of environmental facilities including green space.
Details of the regulation
- Restrictions on the area ratio of production facilities (The upper limit is designated as between 30% and 65% of the plot size, depending on the type of business.)
- Area ratio of green space (A green space area of at least 20% of the plot size must be secured [excluding existing factories]). (In municipalities that have enacted bylaws that provide rules based on the provisions of the Act on the Promotion of Establishment of Enterprises, the percentages provided in these rules shall apply.)
- Area ratio of environmental facilities (Environmental facilities, including green space, landscaped facilities, and outdoor recreational areas, must constitute at least 25% of the plot size [excluding existing factories]). (In municipalities that have enacted bylaws that provide rules based on the provisions of the Act on the Promotion of Establishment of Enterprises, the percentages provided in these rules shall apply.)

2) Filing for change of name of the designated factory (name, address)
Instances where filing is required
If the entity that performed the original filing for newly building (or modifying) a designated factory changes their name or address.

3) Filing for transfer of designated factory
Instances where filing should be performed
If a different entity succeeds the entity that performed the original filing for newly building (or modifying) a designated factory.
Filing to be performed by
- Transferee or lessee of the designated factory in the filing
- The inheritor of the entity making the filing (for individuals)
- In instances where the entity performing the filing undergoes a merger, the corporation that survives the merger or the corporation that is founded as a result of the merger (for corporations)

Factory installation filing program based on the Fukushima Prefecture industrial development bylaw
Factories to which the following requirements apply are required to submit a factory installation filing based on the Fukushima Prefecture industrial development bylaw.
1) Filing for newly building (or expanding) a factory installation.

Instances where filing should be performed
When newly building or expanding a factory with a plot size of 1,000m2or larger.
In cases where the plot size exceeds 9,000m2, or the building area exceeds 3,000m2, the submission of both the designated factory filing and factory installation filing is required.
Instances where filing concerning modification is required
- If production facilities are to be expanded by 300m2or more
- If the area of the expanded portion of production facilities is greater than 20% of the pre-expansion area of production facilities.
Details of the regulation
- Consistency with land utilization plans (Coordination to be carried out to achieve consistency in terms of land utilization with the Agricultural Land Act, Forest Act, City Planning Act, etc.)
- Measures for preventing public hazards (Coordination to be carried out with respect to measures for preventing air pollution, water pollution, noise, and vibration, as well as measures to ensure the appropriate treatment of waste, etc.)

2) Filing for commencement of operations
